Application for MembershipThe information given on the registration form will provide the basis of your assessment for qualification as a Member of ISAM and you agree that all the information supplied is a true and accurate reflection of you as an individual. Should the grade of membership that you are registering for require the information of two supporters to be provided, it is your responsibility to ensure that they are aware and have provided consent for ISAM to contact them in relation to your application. Failure to do so may delay your application. The fee must be paid within 30 days. Should the fee not be paid within this time, your application will not be processed and your information will be retained in ISAM’s database for six months before being deleted. Should you wish to reinstate your application within this period, a further admin fee may be charged. Where the fee has been paid, the Membership Team will review your application against ISAM’s Competency Framework and will advise you of the most appropriate grade of membership (if eligible). You may be required to submit further information or be required to attend an interview. You will be advised accordingly. Upon completion of the application, you will be invoiced for the relevant membership fee. This invoice is valid for 30 days. Should this fee not be paid within this time, your offer of membership will be revoked and your data will be held on ISAM’s database for 12 months before being deleted. Should you wish to reinstate your application within this period, a further admin fee may be charged. By agreeing to these Terms of Use, you declare that you have read and understood the Bylaws of ISAM, the the Statutes of ISAM, the ISAM tobacco policy, the procedures that you have to follow as member of the board and agree to abide by these at all times. Membership of ISAMMembers are reminded that it is your responsibility to maintain your personal record to ensure ISAM holds the most up-to-date information. Failure to do so may result in ISAM not being able to make contact and your Membership being terminated as a result. Membership subscriptions are renewed annually. Notification of renewal will be sent at least 30 days prior to the renewal date and payment is required within 30 days. Should payment not have been received in this time, an e-mail reminder will be sent after a further 30 days. Non-payment of fees after this period will result in cessation of your Membership. Any applications for reinstatement of membership after this time may be subject to an admin fee. By agreeing to these Terms of Use, you declare that you have read and understood the Bylaws of ISAM, the Statutes of ISAM, the ISAM tobacco policy, and procedures that you have to follow as member of the board and agree to abide by these at all times. This data will be held electronically and may be transferred to regional committees, subsidiary companies and third parties both within the EU and elsewhere. As a member of ISAM, you hereby consent to ISAM holding, processing and transferring data ad described in this statement during your membership of ISAM and following the statement’s termination. Terms of UseTerms Conditions - Events BookingThe term 'International Society for Aerosols in Medicine', ‘ISAM’, 'us', 'we' or ‘our’ refers to the owner of isam.org (the ‘Website’) whose registered office is Wohraer Str. 37, 35285 Gemünden, Germany. The International Society for Aerosols in Medicine is a registered non-profit organization (German: ‘Verein’) . The term 'you' refers to the user or viewer of our Website. This page (together with the documents referred to on it) defines the terms and conditions on which we enable you to make a booking for a place on any of our ISAM in-person or digital events (referred to below as an ‘Event’) including, but not limited to, workshops, symposia, training courses, international or regional conferences, webinars, training events. Please read these terms and conditions carefully before booking a place(s) on any of our Events. By placing a booking for an Event you are (where applicable) consenting for your details to be provided to our virtual conference platform provider s, so that they can set up and enable your virtual access to the Event. By accessing an event virtually, you are also agreeing to abide our vitrual conference platform providers terms and conditions. Relevant details will be supplied upon request , for specific events. You should understand that by booking any of our Events, you agree to be bound by these terms and conditions. Event priceThe price of any of our Events will be as quoted in our collateral and on our Website. Prices listed are exclusive of VAT at the prevailing rate unless otherwise stated. Prices are liable to change at any time, but changes will not affect bookings in respect of which we have already sent you a Booking Confirmation, except in cases of obvious error. Event online bookingYou may pay for your booking online by credit and debit card. We regret that we cannot accept cheques, credit notes or cash as payment for bookings made online through our payment gateway. Credit and debit card payments made online through our Website are processed by a secure payment collection service. Our online payment processing on this website is undertaken by Paysafe, a leading secure internet payment service provider. When you book an Eventonline and wish to make payment online, you will be required to log-in to the website. If you are a ISAM Member, you will already have login details. If you are not a ISAM Member you can register to create an online account with us and book an event online. To successfully process your online booking, we will take your name, address and other details, in accordance with our Privacy Policy, and then you will be transferred to a secure page to enter your credit or debit card details and finalise the payment process. The page will form part of the overall ISAM website, however, the form will be provided by Paysafe and will therefore comply with online payment security regulations. Paysafe will need to know certain information about you in order to process payment for the booking and you hereby consent to the transfer by us to Paysafe such information. Please note that whilst ISAM operates secure IT systems, we cannot guarantee the security of data which you send us by email. Accordingly, please do not send us payment information using email. Unless we are fraudulent or negligent, we will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information that you provide us when making a booking. For workshops, training courses or regional /international conferences booked online, payment shall be due immediately. Cancellation of registrations, bookings, including group bookings, are non-refundable. This also applies if the wrong fee has been selected. Event booking (offline)To register for an Event not using our website, you can either:
Contact the team by telephone on +49 6453 58530 36 to make payment by credit card to place your booking. We ask that you do not send credit card details by e-mail or post. ISAM accepts no liability for payment details sent in this way. Payment of invoices issued shall be due strictly in accordance with our standard invoice terms (thirty days from date of invoice, or prior to the commencement of Event). We shall be entitled to charge you interest on late payments. Special offersWe reserve the right, from time to time, to run special promotional offers on Events. Special Offers may include, but are not limited to, price promotions. In the event of a Special Offer, additional terms and conditions may apply which will be made available at the time of booking. Any places booked at an Event prior to the Special Offer will not be offered the promotion retrospectively unless specifically agreed by the ISAM. Promotional CodesFrom time-to-time ISAM will issue promotional codes (‘the Promotional Code’) to chosen individuals/organisations (‘Eligible Purchasers’) that may be claimed against the cost of placing a booking for a specified Event. Only one Promotional Code can be used per order and can only be used in conjunction with any other promotion, special offer or discount where ISAM has provided its express permission. To utilise the Promotional Code Eligible Purchasers must enter/state it prior to completing the order. Eligible Purchasers must not pass on the Promotional Code to third parties. ISAM reserves the right to cancel and refund any booking placed by anyone other than an Eligible Purchaser, using a Promotional Code. Confirmation of BookingAll bookings are subject to availability on the Event and formal acceptance by us, and we will confirm such acceptance to you by sending you a confirmation e-mail stating that the booking has been confirmed (the ‘Booking Confirmation’). The contract between us and you (‘Contract’) will only be formed when we send you the Booking Confirmation. The Contract will relate only to those Events which we have confirmed in the Booking Confirmation. Should there be a limited number of places at each Event these will be allocated in order of receipt of bookings. Joining Instructions (Virtual Events)You will receive joining instructions via email confirming timings and venues once your booking has been processed. If you have not received this one week prior to the event please contact us. Prior to contacting us, please ensure you have checked your email inbox as well as your spam and junk mail, just in case the joining instructions have been sent to these inboxes by your email client. Event ContentWe reserve the right to make changes to the published programme of an Event (but not the overall content), for example to timings and/or speakers if one of the advertised speakers is unable to attend. In such cases, you will not be entitled to a refund if you cancel your place. Event VenueOur Events are held at different venues. You acknowledge that we may have to change the published venue or format (including from in-person to virtual and vice versa) for the Event for reasons beyond our control and in such cases you will not be entitled to cancel unless the change in venue represents a significant disadvantage to you. You are liable for any loss or damage which you may cause to our premises or that of the external venue and agree to adhere to all housekeeping rules, procedures and policies (including policies as to behaviour and conduct) that may be in place at any venue from time to time. If you have a disability or medical condition that requires special arrangements to be made, or specific dietary requirements, please notify us of your requirements when making your booking. Our Cancellation and Refund PolicyCancellations must be received in writing by e-mail to the ISAM Office by emailing office@isam.org Cancellation of registrations, bookings, including group bookings, publications orders are non-refundable. This also applies if the wrong fee has been selected. ISAM reserves the right to retain the entire registration fee in the event that the ISAM Event cannot be held or must be moved or changed due to the following reason(s), though not limited to:
Any persons who are unable to attend an Event they are booked onto may nominate a replacement (“the substitute”) who may attend in their absence, provided that ISAM receives written notice of the substitute’s name, e-mail address and dietary requirements no less than three working days prior to the event taking place. Payment of any difference in the price applicable to the original attendee and the substitute, e.g. non-member rate, must be made prior to the event start date.ISAM reserves the right to refuse entry to the substitute in circumstances where any difference in price (see above) has not been settled or where the substitute fails to meet any eligibility criteria applicable for attendance at the relevant Event. We reserve the right at any time and without prior warning to change the venue or format (including provision by virtual means or vice versa) of the Event and/or Speakers/Chairman from those described in the programme. We also reserve the right in our absolute discretion, to cancel your booking where we need to do so due to circumstances outside of our control (including, but not limited to, situations where sufficient numbers have not booked for the Eventor the speakers are unavailable or cancel the Event or if you are more than 30 days in arrears with any payment due to us, or if it may prejudice our reputation). We shall have no liability for losses or costs which you may incur due to such cancellation, but we shall refund your booking payment (in full as soon as possible) or offer you an alternative Event (up to the cost of the purchase price paid) if one is available. Even if bookings are generally not refundable, ISAM may offer you a refund. In this case y ou have the choice of accepting the refund, a credit note, or attending the alternative Event. In such a event we will usually refund any money received from you using the same method originally used by you to pay for your purchase but reserve the right to refund using an alternative method , by deducting payment or money transfer costs. Transferring to an Alternative EventIf you have booked onto an Event and wish to transfer to an alternative Event, you need to notify in writing the Training and Events Manager at least 10 working days before the event you have booked on is due to take place. Please note, each case is considered on an individual basis. You may only be able to transfer from a booked Eventup to 2 times, after which you will not be entitled to a refund or additional transfer due to the cost of Eventadministration and expenses incurred up to this point. Should there be differences in the cost of a Event, we will notify you to pay the outstanding balance should the new Eventyou have transferred onto exceed the cost of the original training course or regional conference you booked. Should the cost of the new Eventbe less than the cost of the original Eventyou booked the difference will be credited back only if the Training and Events Manager has received your notification to transfer to an alternative Eventno less than 10 working days prior to the date of the original Event. Rights in MaterialsAll copyright and other rights (including all intellectual property rights) in materials provided to you during or for the purposes of any of our Event (including, without limitation, course notes, slides, brochures, articles or case studies) are property of the ISAM or of our speakers. You are entitled to use such materials only for your own personal use. You are not entitled to copy such materials (except as permitted by law) nor are you entitled to use or authorise others to use such materials for any commercial purposes. All our materials state a copyright mark ‘© ISAM 2020’. Our LiabilityEvent attendees shall be required to keep their personal belongings with them at all times and we accept no liability for damage to, or loss of, personal belongings. We do not accept any responsibility for any loss (including, without limitation, theft) of any property occasioned on our premises or at external venues save for any damage caused by our negligence in which circumstances our liability shall be limited to the amount of our insurance for such losses. We will not be responsible to you or any third party for any business loss (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill) or any other loss or damage which does not result directly from our actions. Nothing in these offline event booking terms and conditions excludes our liability to you for personal injury or death caused by our negligence. Events Outside Our ControlWe will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event"). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event. PublicityWe may use photographs taken at Events in publicity and marketing materials, including use on our Website as well as being shared and stored on third-party platforms. Your attendance at an Event may mean that you are featured in such photographs and you are deemed not to object to the taking of such photographs as detailed above. If you do not wish to be included in any photograph, please notify the photographer at the relevant Event prior to the photographs being taken. Recordings (Virtual/Online Events)ISAM reserves the right to record virtual/online Events and by attending such Events you are consenting to ISAM making and storing such recordings. You will receive a notification (visual or otherwise) when recording is enabled. If you do not consent to being recorded, you can choose to leave the Event. PrivacyISAM takes the privacy and security of your personal information very seriously. Our Privacy Policy explains how we collect and use personal information in accordance with data protection laws. Our Privacy Policy can be found at isam.org/Privacy_Statement.aspx A copy of our virtual conference platform provider’s practices and policy with respect of the collection, use and disclosure of user information collected through the use of their technology services can be obtained directly from our virtual conference platform providers. Our Right to Vary These Terms and ConditionsWe have the right to revise and amend these terms and conditions from time to time to reflect changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities. You will be subject to the policies and terms and conditions in force at the time that you place a booking with us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to bookings previously made by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Booking Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Booking Confirmation). Law and JurisdictionContracts for the booking of Our Events (both online and offline) will be governed by the law of Germany. The invalidity or unenforceability of any term detailed in these Terms and Conditions shall not adversely affect the validity or enforceability of the remaining terms and rights.
